1. Agreement to Terms
By accessing or using Purple Cow Tickets ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform.
2. Description of Service
Purple Cow Tickets is a ticketing platform that enables event creators (performers, venues) to sell tickets and attendees to purchase tickets for live events in Canada. We charge a 1.85% platform fee on ticket sales, with creators receiving 100% of the ticket price.
3. User Accounts
3.1 Age Requirements
You must be at least 18 years old to create an account. Users between 13-17 years of age may use the Platform with verifiable parental or guardian consent. Users under 13 years of age are prohibited from using the Platform in accordance with COPPA and PIPEDA requirements.
3.2 Account Creation
You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials.
3.3 Account Types
- Attendee: Can browse events and purchase tickets
- Performer: Can create and manage events, receive payouts
- Venue Manager: Can create events at their venue, assign performers
3.4 Stripe Connect
Event creators must complete Stripe Connect onboarding to receive payouts. By using our Platform, you also agree to Stripe's Connected Account Agreement.
4. Ticket Purchases
4.1 Pricing
All prices are displayed in Canadian Dollars (CAD). The total price includes:
- Ticket price (set by event creator)
- Platform fee (1.85% of ticket price)
- Applicable taxes (GST/HST/PST)
- Payment processing fee
4.2 Pricing Limits
The following pricing limits apply to all events on the Platform:
- Minimum ticket price: $1.00 CAD (paid tickets) or $0.00 (free tickets)
- Maximum ticket price: $10,000.00 CAD
- Prices between $0.01 and $0.99 are not permitted
- All prices must be in Canadian Dollars (CAD) with a maximum of 2 decimal places
These limits are enforced at both event creation and checkout. Purple Cow Tickets reserves the right to adjust these limits with 30 days' notice to event creators.
4.3 Purchase Limits
- Maximum 10 tickets per person per event
- Event creators may set lower limits per ticket type
- Maximum $5,000 CAD in purchases per payment method per day
5. Refund Policy
5.1 Event Cancellation by Creator
If an event is cancelled by the creator, all ticket holders will receive a full refund including all fees. The Platform absorbs payment processing costs.
5.2 Customer-Initiated Refunds
Refund policies are set by event creators and displayed during checkout. Common policies include:
- No refunds
- Full refund until 24 hours before event (minus processing fee)
- Full refund until 7 days before event (minus processing fee)
When refunds are issued, payment processing fees (charged by Stripe) are non-refundable. This is standard industry practice.
5.3 Refund Processing
Refunds are processed within 24 hours and typically appear in your account within 5-10 business days, depending on your financial institution.
6. Event Creator Obligations
As an event creator, you agree to:
- Provide accurate event information
- Honor all ticket sales
- Notify ticket holders of any event changes
- Comply with all applicable laws and venue requirements
- Not create fraudulent or misleading events
7. Payouts
Event creators receive payouts 3 business days after their event ends (based on Eastern Time). This delay allows for refund processing and dispute resolution. Payouts are sent directly to the bank account connected via Stripe Connect.
A transfer fee of 0.25% is deducted from the payout amount to cover bank transfer costs. Event creators receive 100% of the ticket price minus this transfer fee.
8. Prohibited Conduct
You agree not to:
- Violate any laws or regulations
- Infringe on intellectual property rights
- Post harmful, offensive, or misleading content
- Attempt to circumvent security measures
- Resell tickets above face value (scalping)
- Create multiple accounts to bypass purchase limits
- Use automated tools to purchase tickets
Enforcement: We reserve the right to cancel tickets obtained through prohibited means without refund, suspend or terminate accounts, and pursue legal remedies for violations of these terms.
9. Intellectual Property
The Platform and its content are owned by Purple Cow Tickets. You retain ownership of content you upload (event descriptions, images, etc.) but grant us a license to display it on the Platform.
10. Copyright Policy
Purple Cow Tickets respects the intellectual property rights of others and expects our users to do the same. We respond to notices of alleged copyright infringement in accordance with Canada's Copyright Modernization Act (2012) and, where applicable, the U.S. Digital Millennium Copyright Act (DMCA).
10.1 Reporting Copyright Infringement
If you believe your copyrighted work has been copied and is accessible on our Platform in a way that constitutes copyright infringement, please provide our DMCA Agent with the following information:
- A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright
- Identification of the copyrighted work(s) claimed to have been infringed
- Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material
- Your contact information (name, address, telephone number, and email)
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed

10.3 Counter-Notification
If you believe that material you posted was removed or access was disabled by mistake or misidentification, you may file a counter-notification. Counter-notifications must include:
- Your physical or electronic signature
- Identification of the material that has been removed and the location where it appeared before removal
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
- Your name, address, telephone number, and email
- A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if outside Canada/US, any judicial district in which Purple Cow Tickets may be found
- A statement that you will accept service of process from the person who provided the original notification or an agent of such person
10.4 Repeat Infringers
In accordance with the DMCA and other applicable law, we will, in appropriate circumstances, terminate the accounts of users who are repeat infringers.
11. Limitation of Liability
Purple Cow Tickets is a platform connecting event creators and attendees. We are not responsible for the quality, safety, or legality of events.
To the maximum extent permitted by law, our total liability for any claims arising from your use of the Platform shall not exceed the greater of: (a) the total fees paid by you to Purple Cow Tickets in the 12 months preceding the claim, or (b) $100 CAD.
We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption, even if we have been advised of the possibility of such damages.
12. Indemnification
For Event Creators: You agree to indemnify and hold harmless Purple Cow Tickets, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:
- Your events, including personal injury or property damage at your events
- Your breach of these Terms or applicable laws
- Your content, including intellectual property infringement claims
- Disputes with performers, venues, or attendees
- Tax obligations related to your ticket sales
For All Users: You agree to indemnify us from claims arising from your violation of these Terms or your misuse of the Platform.
13. Force Majeure
Neither party shall be liable for failure to perform obligations due to circumstances beyond reasonable control, including but not limited to: natural disasters, acts of war or terrorism, government actions or orders, pandemics or public health emergencies, infrastructure failures, labor disputes, or third-party service outages (including payment processors).
In the event of a force majeure affecting an event, refund policies will be determined on a case-by-case basis, with preference given to full refunds when the event cannot be rescheduled.
14. Dispute Resolution
14.1 Informal Resolution
Before initiating formal proceedings, you agree to contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days.
14.2 Small Claims
For disputes involving claims under $35,000 CAD, either party may bring an action in small claims court in the Province of Ontario.
14.3 Arbitration
For disputes exceeding $35,000 CAD that cannot be resolved informally, the parties agree to binding arbitration administered by the ADR Institute of Canada under its Arbitration Rules. The arbitration shall take place in Toronto, Ontario, and be conducted in English.
14.4 Class Action Waiver
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If this waiver is found unenforceable, then the entirety of this arbitration provision shall be null and void.
15. Termination
We may suspend or terminate accounts that violate these terms. You may delete your account at any time. Termination does not affect existing ticket purchases or pending payouts.
16. Changes to Terms
We may update these Terms periodically. Continued use of the Platform after changes constitutes acceptance of the new Terms. Material changes will be communicated via email or platform notification at least 30 days before taking effect.
17. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any legal action must be brought in the courts located in Toronto, Ontario, and you consent to the jurisdiction of such courts.
